Mockingbyrd — Privacy Policy

This policy covers the Mockingbyrd macOS application (the "App") and the website at mockingbyrd.io (the "Site"). Mockingbyrd runs on your Mac and keeps your data there. We collect only the small amount of personal data needed to send you activation codes, updates, and documentation, and to run the website. This policy explains what that is, why, and your rights under the EU and UK GDPR, Swiss law, and US state privacy laws.
1. Who we are
The controller is 3Cubed LLC, a Delaware limited liability company, 2219 Main St., Unit 588, Santa Monica, CA 90405, United States of America ("Mockingbyrd", "we", "us"). Contact: Michael Schoening, [email protected], +1 (773) 548-2226.
Individuals in the EU and UK can reach us directly at [email protected]. We will list our EU and UK representatives (GDPR and UK GDPR Art. 27) here once appointed. We have not appointed a Data Protection Officer because we are not required to.
2. What stays on your Mac
The App reads permission lists, configuration files, hooks, agent definitions, session logs, and tool calls on your Mac to produce scores, fixes, alerts, and the token ledger. All of this is processed locally. We do not receive it and cannot see it. The App has no account and no login.

We use each email address only for the purpose you gave it for. We do not combine it with other data, sell it, or use it for advertising.
The Site does not use cookies that require consent.
Do Not Track. We do not track visitors over time or across third-party websites, and we do not allow third parties to do so on the Site. We therefore treat all visitors the same, whether or not their browser sends a Do Not Track or Global Privacy Control signal.
We make no automated decisions with legal or similarly significant effects about you. The App's scores are calculated locally and are advisory.
4. Legitimate interests
Where we rely on legitimate interests, those interests are running a secure website, delivering updates, and responding to feedback. We have weighed them against your rights, and you can object at any time.
5. Who we share it with
We share personal data only with service providers that process it on our behalf under contract:
- Amazon Web Services, Inc. (AWS), United States: hosts the Site, delivers downloads and updates, and keeps server logs.
- Google LLC, United States: email and forms; receives form submissions and sends activation codes and update emails.
Both providers process data in the United States. These transfers are covered by the safeguards described in Section 6. A current list is available on request at [email protected].
We may disclose data if required by law, to protect rights and safety, or to a successor if Mockingbyrd is reorganized, merged, or sold.
6. International transfers
We are based in the United States. When personal data from the EEA, UK, or Switzerland goes to the US or another country without an adequacy decision, we rely on the EU Standard Contractual Clauses, the UK International Data Transfer Addendum, or a provider's certification under the EU-US Data Privacy Framework. You can request a copy of these safeguards.
7. Your rights
EEA, UK, and Switzerland. You can ask to access, correct, delete, or port your data, to restrict processing, or to object to processing based on legitimate interests. You can withdraw consent to build-update emails at any time via the link in each email or by writing to us. You can complain to your data protection authority, for example the ICO in the UK or your local EU authority listed at [edpb.europa.eu](https://edpb.europa.eu/about-edpb/about-edpb/members_en).
United States. Depending on your state, you may have rights to know, access, correct, delete, and receive a copy of your personal information, and to appeal our decision. We do not sell or share personal information for targeted advertising, and we will not discriminate against you for using your rights.
How to ask: email [email protected]. We answer within one month (GDPR) or 45 days (US), extendable where the law allows. We may ask you to confirm the email address you used.
8. Security
We keep what we collect to a minimum, use encrypted connections, restrict access to the few people who issue codes, and use providers with recognized security practices. The App is signed and notarized by Apple. If a breach affects your data, we will notify you and the authorities as the law requires.
9. Children
The App and Site are not directed to anyone under 16, and we do not knowingly collect their data.
10. Future features
If a future version sends any data from your Mac to us or a third party, such as crash reports, usage statistics, or an AI assistant, we will update this policy before release and, where required, ask for your consent first.
11. Changes to this policy
We will post updates here with a new effective date and announce material changes on the Site.
